What is apartment law?
Apartment law is a share in the ownership of a building, combined with an exclusive right of use of a specific part: the apartment itself. Additionally, you have the right to co-use common areas, such as the entrance, elevators, stairwells, and roof.
An apartment law right arises through a division deed, drawn up by a notary. This deed divides the building into multiple apartment rights and describes, among other things, the intended uses and the common parts. With the division, a Homeowners' Association (VvE) is automatically established, of which membership is legally required. The VvE is responsible for the management, maintenance, and financial administration of the building.
In larger buildings, there is often a main division and sub-division, for example, in a complex with residences, shops, and a parking garage. This leads to multiple VvE's within one whole, making the legal and administrative landscape even more complex.
